h1B Payrol and SSN

hello,

Recently i got my first h1b approved in Oct 2012. Since the market is slow because of the year end. Really appreciate if some one can guide me with below queries.

1. does my employer need to run the payroll for me until i get a job.

2. In case if we don't apply for ssn are there any demerits.

You HAVE a job. Your job is with your employer.

Your employer needs to pay you, even if he doesn't have a project for you. That's the law, and the employer knows it.

And you need to apply for an SSN. The employer needs the SSN to pay the income taxes he has to deduct from your paycheck.

If your employer doesn't want to pay you, filed a complaint with DOL on form WH4. The DOL will make the employer pay you.

And I suggest you look for another employer, one who follows the law.

1. Yes.

2.You have a job offer. It's better to apply for SSN.
