H1 to H4 Change of status -very urgent plss

Hi,

I was on H4 and have got my H1 approved this year through california based employer. I am in omaha searching for jobs, but now my employer is asking me to come to california and stay at the client place till i get a job. I have a 2yr kid to take care of and cant go to california. but my employer is not all listening to me.

Can you please suggest me what i can do ? Can i change my status back to H-4 with out any paystubs and convert to H1 after i get a job.

or do i need to go out of the country and comeback on new H4 . ( i dont have my SSN nor the I-797 Copy)

Please suggest me.

I would honestly suggest discussing your problem with the firm of Murthy. He will claim you did not bother to report and you will fall out of status. You can get back into status by leaving and coming back on a H4 visa. Stay away from such employers even if it means waiting longer.
