Since I only came to know of the approval yesterday (i.e., 16th Oct), can I still serve my 2 weeks notice period with L1 B Employer A? Employer B has only received an email approval and the I797 form has not been received in the mail. Link to comment

For all you know you got divine inspiration and resigned your L1 job with 15 days notice and coincidentally you found out after 15 days that your H1 had been approved. Any collateral damage would be potentially u8ndone the next time you come back on the H1 visa. On the other hand whatever happened to 15 days salary in lieu of notice? Link to comment

Employer B got my H1 Approval and starting date(15thOct) on 16th Oct. I put in my resignation with Employer A on 16th oct. Now can I still work with Employer A for the 2 weeks notice period if the starting date for H1 B Visa is 15th Oct? Link to comment
pontevecchio Posted October 18, 2012 Report Share Posted October 18, 2012 Once you change your status to H1 you cannot work for the L1 employer. You may choose to ignore it and decide that they are not going to penalize you significantly if you work without authorization for 2 weeks. On the other hand you could discuss the matter with a Lawyer. Link to comment
