bluntman Posted October 14, 2012 Report Share Posted October 14, 2012 Hello, In this situation : - Permanent resident sponsors his spouse via I130 to obtain a GC - Spouse is living abroad ( while waiting for the Priority date to become current ) After the PD is current I understand that Consular processing needs to happen ( in our case, this will happen in Paris, France ). After Consular Processing is complete, the spouse can move to the US. Adjustment of Status ( AOS ) would not be necessary ( I think ) What is the approximate timeline from the time the Priority Date is current and the time the spouse can move to the US and obtain the GC ? JoeF Posted October 15, 2012 Report Share Posted October 15, 2012 AOS is only possible while the person is in the US. CP indeed replaces AOS for a person who is abroad. Once the PD is current and all paperwork for CP is is filed (see the National Visa Center website, http://travel.state.gov/visa/immigrants/types/types_1309.html for what is needed), it usually takes 2-4 months to schedule the interview and get the Immigrant Visa. Finally, 2 more final questions : - between the time the PD is current and the process CP is complete, can the spouse come to the US as a tourist ( under the visa waiver program ) for a few weeks ( up to 3 months ) ? - Will I ( the sponsor ) need to come for the interview at the consulate ?
