How much time he has on H1b to look for a new employer who is willing to transfer same H1b ? What's the next action here? Can someone please recommend? Link to comment

JoeF Posted October 13, 2012 Report Share Posted October 13, 2012 Is the "friend" you? There is no grace period. A person who is laid off is out of status from that moment on. The company by law has to pay for your flight to your home country if you decide to go back home. If you want to stay and try to find another job, you should file a COS to another status, e.g., B2 immediately. Link to comment

On H1B,if an employee is laid off that means he/she is out of status. Link to comment
pontevecchio Posted October 13, 2012 Report Share Posted October 13, 2012 lEGALLY HE HAS NO TIME. iF HE THINKS HE IS GOING TO GET ANOTHER JOB HE CAN TAKE THE RISK OF STAYING FOR A COUPLE OF MONTHS. He will need to come back on a H1 visa if another employer files and gets his H1 approved. Link to comment
