tach Posted October 12, 2012 Report Share Posted October 12, 2012 my i94 extension for l1b got RFE(employer A).....on sep 1st 2012..which we are yet to respond, due date to respond is nov 15th 2012... i94 has expired on july 2012..we applied for extension before expiry... mean while my employer B applied for h1b in june 2012... which got APPROVED on OCT 12TH 2012... 1. what will be my status of stay now..? 1...am i being out of status..? 2... till when can i work for my emplyer A? 3...what should be my plan of action....? But before joining the sponsor I am ensuring I am doing the right thing. Am I good to join H1 Sponsor , even though my L1B Extension got RFE and yet to repond to RFE, wanted to make sure I am doing the right thing. Link to comment

Ateeq Posted October 14, 2012 Report Share Posted October 14, 2012 Ask employer B how did they file your H1? was it as H1 with "change of status" or "without change of status". If filed as H1 change of status, then you can no longer work for employer A. You are on H1 and your L1 has become invalid. If filed as H1 without change of status, then you are still with company A on L1. for you to change , you either need to make a new change of status application while continuing to stay in US or go out of US get H1 stamped at the foreign cosulate. I think I have to wait and continue in L1B job till I see the documents. Once I receive the physical documents , how soon should I join H1B employer if approved with COS. Thanks Link to comment
