H4 visa for dependant when having 2 months remaining on my h1

I am having H1 visa till 28th Feb 2013, my company is going to file for extension in Jan 2013.

I am going to india from Novemeber 21st to December 15th 2012 for my wedding.

My confusion is whether my wife can get H4 visa when i have validity only till 28th feb i.e when she will be appearing for visa interview the duration left on my visa will be less than 3 months.

Yes if your company is absolutely and clearly legitimate.
