Immigrant72
I work with company X that has filed for my Green Card under EB3. I-140 was approved back in 2010 and my H1-B got extended by 3 years - it expires in Sep.2013 (i.e. less than 1 year from today) I have a job offer in the same job family, reponsibilities and job description from company Y - they will transfer my H1-B and also file for my green card My questions: When company Y transfers my H1-B, can I get a 3 year term or will the transferred H1-B have to expire on the above date of Sep.2013? Once transferred, when company Y applies for my green card, can I keep the same priority date as my current application, even though company X may revoke my I-140 at some later date? Thanks for your inputs and guidance! Link to comment
pontevecchio
1. You can get 3 years if applicable. 2. Yes. Link to comment
Immigrant72
Thanks Pontevecchio...Regarding question # 1, could you provide more guidance on the term 'if applicable' ? What factors support this request for a H1-B transfer request with a 3-year term? Response greatly appreciated! Regards. Link to comment
