H1-B transfer after EB3: I-140 approved

  1. I work with company X that has filed for my Green Card under EB3.
  2. I-140 was approved back in 2010 and my H1-B got extended by 3 years - it expires in Sep.2013 (i.e. less than 1 year from today)
  3. I have a job offer in the same job family, reponsibilities and job description from company Y - they will transfer my H1-B and also file for my green card

My questions:

  1. When company Y transfers my H1-B, can I get a 3 year term or will the transferred H1-B have to expire on the above date of Sep.2013?
  2. Once transferred, when company Y applies for my green card, can I keep the same priority date as my current application, even though company X may revoke my I-140 at some later date?

Thanks for your inputs and guidance!
