VeeVisa
I am currently on H4 and looking to apply for a H1-B visa to further my career. I was in the US with a H1-B through my former employer. Can you tell if I am eligible for 'Cap Exempt' H1B now? To help understand my status better, I have listed the different US visas I've held over the years. 1) H1-B (01/2005 to 10/2007) - In US for 9 days in July 2005. Never came back on this visa due to personal reasons. 2) H4 (02/2008 to 02/2010) - In US between 12/2008 to 04/2009. 3) B1 (Issued in 12/2010) - Currently invalidated. Traveled in 12/2010 for 3 weeks. 4) H4 (01/2011 to Currently valid) - Currently in USA on this visa. Link to comment

pontevecchio
You would need to discuss your situation with a GOOD Lawyer. It is possible to reclaim the remainder which is almost 6 years. Link to comment
