H1 transfer / notice period

1. If a person who is holding an H1B visa for company A and company B applies for a transfer and the transfer is approved, can the visa holder decide not to transfer to the company B? How long can the person still work for company A (Will the person have time to serve a notice period)?

H1B transfer is not an overnight process, it take more than 2 weeks from beginning to end, so you will have plenty of time to give the notice.

thanks but I want to wait untill trasfer is approved and then give the notice, my question was is it possible?

I know some people start working with the new company after getting the reciept, I don't want to do that. So thats why I was curious. But now I found out that it is possible.

People do all kinds of stuf, you can read about them on so many forums just like this. But again it is up to you what you want to do.

Yes, you can starting working for the new employer after you get the receipt. How much notice you give and when will again be dependent on your empolyment contract with your current employer.

In a H1 to H1 situation you can serve the notice period after the new petition approval and then join B.
