Prashanth0081
Hello Sir, I have my Visa stamp from my previous employer still September 2013, I am planning to take a vacation to India. Is my previous employer visa stamp still valid to reenter USA, even if my previous employer cancelled my Visa. Sorry, for some reason, I could not reuse my previous post. Thanks, Prashanth. pontevecchio
You mean even if your previous employer revoked the Petition. Yes, you can use the old visa with the new approved H1 petition. Link to comment
Attorney_22
While an I-797 H1B Approval Notice is tied to a particular employer, an H1B visa stamp is tied to the status. Thus, generally as long as an individual possesses a valid H1B visa in their passport and is maintaining H1B with a new employer, it is not necessary to obtain a new H1B visa when traveling abroad simply because there has been change in H1B employment. However, please be aware there are instances when a visa may be considered canceled prior to its expiration date, for example, when there has been a determination that an individual works in the U.S. without authorization. Please contact a qualified U.S. immigration attorney with any other questions. Link to comment
luck2u
@Prashanth0081: Yes, you can reenter to United States with your previous employer's visa that H1B petition was revoked. Make sure you show the new employer's I-797 in port of entry so that you will get new I-94 as per the I-797 validity. Link to comment
