rita123 Posted September 13, 2012 Report Share Posted September 13, 2012 Hello Guys, I need some advise on the following immigration situation regards to GreenCard: My Priority Date is May 2009 and me, my husband got EAD card 6 months ago. Our I-485 is pending still. I am planning to change the employer now, when contacted my current employer regarding the same, i was told that he will cancel my I-140. Since I have my EAD approved, am planing to change employer on EAD status. Is it risky to change employer on EAD with AC-21 filing( while employer cancelling I-140). Is it less risky to change the employer on H1 and start new GC processing ? or is it better to change on EAD with AC 21. Please advise..!! Link to comment
pontevecchio Posted September 14, 2012 Report Share Posted September 14, 2012 You could do both if possible. Why did you mention it to your Employer? Make sure you get a Lawyer to guide you till the GC. A months salary, possibly half a months salary is a pittance for piece of mind. AC21 should not be a problem as long as you have a Good Lawyer on your side. In this case you will need to file the letter since your current employer is an idiot. Link to comment

But a Lawyer would be able to go over the details of both jobs and guide you as to what is the best way in view of the previous Employer threatening to revoke the 1-140. It should not affect you.
