H1b Visa cap exemption

Hi Guys,

I went to India in Jan 2012 and I gave H1b stamping interview on Jan 20th 2012.

I got 221g admin processing. I waited for 5 months and the consulate didn't reply.

So I came back on H4 visa.

So now the situation is I have H4 on my passport and my H1b admin processing is still going on.

Somebody told be that I'm H1b cap exempt for one year.

Now my question is till when?

Jan 20th, 2013?

If my employer doesnt file for my h1b again till Jan 20th, 2013, then will I have to again wait till April, 2013?

Please help. I shall be highly grateful to you.

You are cap exempt for a total of 6 years in H1 status with no single period more than 3 years.
