L2 EAD to H1 change of status

Hi,

Currently I am working on L2 EAD and it is valid April, 2013. Employer A has filed my H1B and it got approved effective from Oct 1st, 2012 to Nov 15th, 2015.

My queries are:

A. Will my status change it to H1B automatically from Oct 1st,2012?

B. If so, how many days we can stay in US without working?

1. Yes, if there was a COS. 2. How do you figure that.? The H1 petition means work or fraud if no work.

If you are working on EAD for Employer A now, then it shouldn't be a problem at all and the COS will be effective from Oct 1st. If not, it's a problem

I just came to know that my employer filed my H1 without Change of Status. That I came to know after seeing my I-797. It has same I-94 number which I got when I entered in US first time.
