Falcon_7X Posted August 30, 2012 Report Share Posted August 30, 2012 I am in 5th year of my H1B visa. I worked for Company A for about 3 years. Company A filled for my Green Card (GC) in the past. My PERM and I-140 got approved with Company A under EB-2 category, but I was not able to file I-485 at that time since my priority dates (PD) were not current. Then I left company A and joined Company B. During my employment with Company B, my PD became current and the Company A helped me in filling for my I-485 as future employment case. It has already been over 180 days since I have filled I-485 with Company A. My job profile at Company B is very similar to my Company A job profile. My questions are: 1. Can I use AC21 to transfer my GC process to company B? It means after using AC21, when PD will be current, I should be able to use the green card and still be able keep working at Company B without any issue. 2. If answer to que #1 is yes, do I need any supporting documents from Company A or Company B to file for AC21? Thank You for your valuable time and support. Link to comment

Company A is not doing any Charity, I see it as a good relationship and open mindedness. Company A is a decent size american Mechanical Engineering conuslting firm and they always need ppl and would like their old employies to come back. That is why they are doing this. Cheers!
