Both our I94s expire on September 21, 2012. Do I or my wife have to leave country if extensions are not approved before September 21? Thank you :) Link to comment

nineballs Posted August 30, 2012 Report Share Posted August 30, 2012 This period of stay would be called authorized period of stay. Technically, you won't have any status during this time but it's legal to stay since you have an extension in process. Don't leave the country during this time. Just in case, the extension gets denied, then you would be considered illegal and the period from i94 expiry till the time u leave the us would be considered an illegal stay. Link to comment
