L to H confusion....Pls suggest...

I am on L2 and my Husband is on L1.

Both of us have filed for H1b for year 2013.

My question is :

1). If my husband gets his H1b approval first, then will I be 'Out of status'...? (Although my application was filed first)

2). If both of us get H1b approval before Oct, will I be 'Out of status'..?

3). Pls suggest if I have to do any additional thing from my side under these circumstances....

From the H1 start date (different from the approval date) on your husband will be in H1 status, and your L2 status would be invalid.

But you are legal while your H1 application is pending.

The status will apply after October,1 assuming the H1 petitions were filed with COS and are approved. Once he is in H1 status your L2 status is no longer valid.

We are planning to do Premium Procsessing for my husband's H1b application - in this case, if my husband's H1b is approved before Oct1 and my H1b is still pending processing on Oct1 -

1. Can i continue working with my current job after 1st Oct..?

2. Will I be Out of status if my H1b is pending when my Husband is on H1b...?
