Jay12345 Posted August 29, 2012 Report Share Posted August 29, 2012 At the end of the 6th year of a H1-B, while the Labor is in an audit, if one changes the visa from H-1B to F1 or B2 while staying in US and when trying to change the visa back to H1-B after an approval of the I140, will their H1-B count against the new cap or will it be an extension of the first H1-B?
