madhav.bhogaraju Posted August 28, 2012 Report Share Posted August 28, 2012 Hello, My L1B visa will end on Jan 12th 2013 due to completion of 5 years of stay in US. My wife is 6+ months pregnant and the delivery is expected in December (around 20th - 27th). Initially, due to health reasons, my wife couldn't travel back to India. My Employer also talked about Visa extension and all. But now I am having back and forth discussions with my employer and really worried as I haven't still heard any concrete plan from them. My employer is saying that me and my wife might have to stay on a Visitor Visa after Jan 12th, which is surely not an option for me. Please suggest any better option to extend my stay beyond Jan 12th. and also be eligible to work. Regards, Madhav. Link to comment

One needs to know the nature of the medical problem which precluded travel. Has any Licensed Physician in the USA told you guys that she should not travel home for the delivery? You may be able to change to a visitor visa, but you'd have to file the application yourself for you and your wife. That's pretty much it. There is no other option, except for leaving the country.
