jagan164 Posted August 28, 2012 Report Share Posted August 28, 2012 I work for Company ‘A’ - very big Indian IT organization (joined in USA a year back and has 5.2 years of experience before joining). Company A said they will initiate my GC process in next few months (Probably by end of the year). Now I got an offer from Company B who is ready to sponsor GC for future employment. Is it legal for company A and B to sponsor my GC at the same time? If company B files under EB2 and company A files under EB3 will it cause any issue? Who will decide under which category (EB2/EB3) my application falls (my company or DOL)? I have Bachelors in engineering (4 Years) + 5 years of IT experience (Before Joining Company A). Am I eligible for EB2? if company A files the PERM application for “Computer systems Analyst” position with about $ 40 per hour as a PW? Link to comment

The designation EB2 OR EB3 is based on the job requirements and decided at the time of I-140 filing based on the job requirements. 3. see 2. 4.
