H1 Transfer, H4 Issues

Hi,

Could you please provide more info on below item?

I am transferring my H1 to new employeer B, do i need to do same for my wife also? she already have valid H4 with employeer A and she is in india currently. Will there be any problem when she travel to US even though my H1 transfer not approved Yet.

She has a H4 visa and when she enters with a H4 visa and your Latest H1 valid petition she gets H4 status. It has nothing to do with your new employer. Her I94 will be till the expiry of the H1 petition for the company you are currently working for.

1. Does she has to bring any other documents other than her valid VISA,and I797 ?

2. Would i get any documents from USCIS when i apply for transfer of h1?

3. I am not going for Premium processing, so it takes around 90 days to get my h1 transfer, can my wife travel to US during this time? can she tell my new employer name at POE? and also,

4. If i moved to new location in US under new employer, does POE entry matters for her or she can land in any POE?

BH.... Sorry, I do not think she can come in based on a pending H1 transfer for you. The response box here is an absolute pain designed by a person who has never been actively involved in a forum. I digress. Talk to a lawyer or convert to PP.
