vic Posted August 28, 2012 Report Share Posted August 28, 2012 My H1b was applied and approved as a Change of Status From 1st Oct Now I want to leave my current employer (L1) on 28th Sep and take a week off. i.e. (29th Sep – 7th Oct) Join the new employer (H1b) on 8th Oct. Also what will be my status for 29th & 30th Sep? Is it a major concern/legal issue when I go for 1. H1b visa stamping in future. 2. GC processing Scenario - Last date of employment on L1 with current employer – 28th Sep. One week off. i.e. (29th Sep – 7th Oct) Start date of employment on H1 with new employer - 8th Oct. pontevecchio Posted August 28, 2012 Report Share Posted August 28, 2012 I am a bit surprised that you are not aware that you have up to 60 days to report to the H1 sponsor. Why did you not call HR in the new company and ask? Link to comment

You wont be out of status if you have a paystub for the previous month and a week doesnt count at all. we all worry too much for these little things. I was in the similar boat earlier Link to comment

If a change of status is granted effective October 1, and the beneficiary fails to join the petitioner on October 1, he/she will generally fall out of status immediately. Link to comment
