I am currently in US on L1 thru company A, and i have a H1 petition approved through company B. Since my current organization has a notice period of 2 weeks, can i resign from A and work for 2 weeks after i know the COS status ? Will it be illegal ? Thanks Sandeep Link to comment
pontevecchio Posted August 25, 2012 Report Share Posted August 25, 2012 Since the H1 is approved what exactly does Knowing COS status mean. Have you not got an I94 with approval from October,1? Resign in mid September and then leave and come back with a H1 visa. Link to comment
sandeep_kum Posted August 26, 2012 Author Report Share Posted August 26, 2012 My H1 is applied with COS and in I-797 it says valid from 0ct 1st 2012 - 2015. Should i need to leave US ? I thought i can apply for COS to convert my visa from L1 to H1, am i not correct ? Should i leave my L1 employer by oct 1st or is there any grace period ? Link to comment

Count the 15 days accordingly and give notice to your L1 employer on or about September12th. Link to comment
khapee Posted September 5, 2012 Report Share Posted September 5, 2012 Hi, My L1A visa is valid till 13 July 2013. H1B COS is applied on 30 April 2012 and still pending in initial review. My question is that if H1 gets approve then my status will automatically change on 1st October (or on the date mentioned in approval notice if it comes after 1st Oct) or it will only change when I join the new employer?
