joeferns79
I am planning on doing an H1 transfer from Comp A to B. The main issue is I've got paystubs only upto July 15( i.e. period from June 15-30). When the USCIS wants to prove that I was in valid H1 status, how far back do they usually look for proof through paystubs? Link to comment
JoeF
Why didn't you get paid since then? On H1, you have to get paid all the time, even on bench. Link to comment
joeferns79
JoeF - I understand that but I wasn't paid since the client didn't pay my company. It is what it is, can't help it. Link to comment

Well, the company still needs to pay you. It is the law. And the company promised the US government that they will do that. You can not transfer if you don't get paid. File a complaint with DOL on form WH4. The DOL will make the company pay you. And next time, find a better employer, one who isn't a fly-by-night operation without money. Link to comment
JoeF
JoeF will now say..it dosent matter if the Client paid your employer or not..you should be be paid for your service...your employer should pay you...ALL the TIME!! Period. LOL. Indeed. And a transfer is only possible if the person gets paid, or files a WH4. Link to comment
joeferns79
Say I file the WH-4, etc, do I then send that along with the H1 transfer application to let USCIS know that I wasn't paid? Would they be okay with the Transfer then? Link to comment
pontevecchio
They might be. A good chance specially if the new sponsor is legit. Or leave and come back on the visa at that time. Link to comment
