I got my H1B extn for 3 Years using I140 i ahve 2 Years left with company A and my stamping also have 2 years. and i crossed 6 Years H1B.am still working on H1B. I filled my I485 on April 10th 2012 and got my EAD in May 2012.I can use my EAD after October 10th using AC21.(My PD is Sep 2009) I got an offer to join Company B(Reputed Financial Institution) to join and work form October 2012.But i dont want to use my EAD because i am not married yet and am plnning to marry in this december or Jan. I am getting suggetions to do the H1B Transfer to company B in October and start working for them.So it will not impact my EAD, i am structing in this point. 1. Is the H1B Transfer needs to submit my I140 to get transfer ? (Since i got my EAD How its gonna work) 2. Do i need to got for stamping again after the transfer if i want to out of country ? (Or can i use my old stamping with new approval to come back). 3. Is there any way will it impact my EAD/GC process if i do the H1B Transfer? 4.Is it safe if i do the H1B Transfer (Since i have an EAD INS may come back and ask the reason). JoeF Posted August 23, 2012 Report Share Posted August 23, 2012 Sure you can get an H1 transfer. Simply having an EAD doesn't change that. Using an EAD would be a different thing. Link to comment
pontevecchio Posted August 23, 2012 Report Share Posted August 23, 2012 All you need to be is awaiting AOS before your PD is current and you can marry in the meantime. But since you may want to avoid follow to join and want her here in H4 status discuss it with the new company. They can file your H1 petition if they choose. Link to comment
