jas123 Posted August 17, 2012 Report Share Posted August 17, 2012 I m in 5th yr of my h1 with company A and got an offer from Company B,how long will this take? when is the safe time to resign company A? should LCA be before filing H1 transfer? should i opt for premium processing? Company A had filed my Green Card and petition was approved ,will everything start over again with company B? jas Link to comment
SameerH1Bworker Posted August 17, 2012 Report Share Posted August 17, 2012 - LCA is must before filing H1 transfer - PP is better nowadays. - If you've filed I-485 before 180days & waiting for its approval then you can use AC21 with company B. However, if you've just PERM and/or I-140 approved from company A then you'll have to start the process again with company B. However, you can retain PD if you've approved I-140 from company A.
