could not go to usa(and stamping) after petetion approved in 2007.my consultant say form I797 expired last year.is there any to extend it or reapply for visa to go usa.

You would need to find a H1 sponsor to file a non cap H1 petition for you and get it approved before going for the visa stamp and coming over.

1)this non cap h1 can be filed any month or only when they start to take general petetion (usuaaly in april)

2)I have petetion number only and .consultant does have the petetion doc which he wont give so,only on basis of petetion number other cnsultant may file non cap h1?

It can be filed anytime. I will tell you that this is not 2007/2008 and the climate is very hostile for DCC's if that is your goal. You may do better staying back or come over for actual study in a known Institute and then go via the H1 route.
