Mat Patel Posted August 13, 2012 Report Share Posted August 13, 2012 Hi! Mumbai consulate has finally sent me an email and asking for my wife's passport. She got a 221G blue form and we had submitted all the requested documents in May 23. Now my I-797 is expiring on end of September 2012. I have already filed H1-B transfer petition and will get the approval most probably by end of next week. I was working for company A when my wife appeared for H4 and after 221G we submitted all the documents and I changed my employer and company B is my direct employer. Questions: (1) My wife will have H4 visa valid for two months as she appeared for her visa when I was working for company A (EVC Model) -- is there any problem she will face at port of entry??? Will they ask any questions ???, is it ok to show them a new approved I-797 (from company B direct employer and client) in case if they say that your H4 visa is going to expire in two months when will you be leaving the country?? (2) Should I rush her to come here asap as her visa will expire in two months?? Any suggestions will help. Thank you for your time and suggestions in advance Link to comment

Her period of stay will be based on the I94 on arrival which will be till your latest H1 petition expiry. In order to avoid aggravation she can inform the consulate about the matter and get a longer stamp. Link to comment
