H1B extension based on Re-capture

Hi,

I am on my 6th year of H1B and i have 300 days to re-capture. My PERM was applied on 01- Aug-2012 and i am doubtful that my PERM will get approved before Sep 30 2012.

I was told that it is Mandatory for INS to approve the recapture days. Is this True?

My Question is what is the Probablity of H1B extension re-capture be successful?

Since my H1B expires on Sep 30 2012 would going for premium processing be beneficial or not?

Nothing is mandatory. If you have proof of the days claimed they will approve your H1 petition. PP would be beneficial in the sense that the Lawyer filing the petition will have direct phone access to the Officer in case of need and hence can deal with any questions raised.
