vin_blue
Hello, I filed H1-B visa under premium processing in April 2012. I got an RFE (for client letters and other documents) by April end and responded back to it in May. On June 3rd, my H1-B got denied since we did not submit the client letter. Now, the client gave me the client letter and on July 27th, my attorney have filed I-290B, Motion to re-open/reconsider. My question is : 1. Any idea how long the appeal will take? 2. What is the process for Motion to Re-open / Re-consider? 3. Any idea what are the chances to get my H1-B approved? I have moved back to India and am waiting for my H1. Please help me out if you have any pointers for appeal. I tried googling it and also searched in this forum but its bit confusing. Any help is much appreciated ! Thanks, Link to comment
pontevecchio
I am not being flippant. The H1 is filed by the sponsor. You have no stake. It would seem a tad silly to have filed with no client letters. But you may get lucky. I doubt it. You should be prepared for a filing again next year. Link to comment
vin_blue
Yes, thats true. During my RFE, USCIS asked for client letter but the client was NOT ready to give one. They have given it once it got denied !!!!!! I don't have much hopes on my H1 but I don't want to wait indefinitely........ Link to comment
