Here are my credentials: - Labor filed : July 25th 2011 and labor is still pending - H1B (all six years) got expired on June 4th 2012 - Moved to H4 using my spouse's H1B VISA - As of today (August 9th 2012) my Labor is pending for over 365 days - My employer has filed LCA. But they filed it effective of September. Does this mean that my H1B can be effective as of September only ? If yes, is there any way to make it effective earlier than that ? I am out of job for 2 months now, any help on this matter would be appreciated. Thanks Link to comment

naf1980 Posted August 10, 2012 Author Report Share Posted August 10, 2012 I talked to my employer but they are saying this is standard time. They cannot file before this date. So in essence they are filing for my H1 to be effective 2 months over of my 365-labor--pending-date. I have a client opportunity available because I have been working for this client for 6 year. Even then my employer is not filing for my H1 early. Now I am not able to understand - If I am not able to understand the process of H1 extension after 365 days of labor correctly - Or my employer is not interested in filing my H1 at all. Please help me to clarify this. Is there any lawyer I can talk to clarify this issue ? Link to comment
pontevecchio Posted August 10, 2012 Report Share Posted August 10, 2012 You can call the firm of Murthy and make an appointment should you choose. You can get extensions of the H1 even later. Has the PERM been filed by the same company? Link to comment
