polka.nj
Hi, I am on academic H1B and have recently changed employers (H1B academic to H1B academic). I have my old employer's i797 approval, I do not have a visa stamp. My new employer has applied for H1b visa and I have the receipt. I was told it can take 10-12 weeks as it's not premium (CSC). I am going to India in a few weeks, and plan to get my visa stamping done. I am wondering if I need to upgrade my to premium H1b visa transfer so I have the i797 before stamping. I had emailed/called the consulate asking if the old employer's i797 is sufficient along with the new employer's receipt. There hasn't been a response from them, so I'm not sure if I need to upgrade to premium processing for the transfer. Any responses to this situation will help. Thank you! Link to comment
pontevecchio
You will need the latest H1 petition approval. You cannot get a visa based on the previous petition. Link to comment
