If I140 gets denied is H1B also revoked? if it gets approved is the one year duration on top of what I say. Its always on approved PERM. and the extension is for an year. if 140 gets denied even then H1 extension doesn't get denied, I guess. if it gets approved is the one year duration on top of what I say. Extension for one year, yes we all know. Is H1B revoked with denial, what is the certainity; no guesses please? if you have approved 140 before applying extension, then its 3 years. remember, no H1 extension can exceed 3 years whatever be the case. Pending I140 for more than one year means one year H1 extensions and a pending appeal may allow extensions. In the absence of fraud any approved H1 petition will be approved till it expires irrespective of the basis. Link to comment
