mk1980gc
Hi attorneys/experts I'm into my 7th year of H1B and my GC is under processing got I140 approved in 2010. Visa stamp in passport expired in 2010. My current H1B will expire in Dec 2012, since i have plans to visit India in november i asked them to apply for Extension (i thought of going for stamping with new H1B so that visa stamp will be for 3 years) and they are ready to apply it in premier. i have couple of questions here, can someone please clarify them... 1) will i get new H1B for 3 years from Dec 2012 or from approval date? 2) if i get new H1B from Dec 2012, can i go for stamping with both current and new H1B and visa stamp will be based on new or current? Regards mk Link to comment
pontevecchio
1. Your new H1 petition should be for 3 years. 2. Take both and get the visa based on the later approval. Link to comment
