nandac Posted July 19, 2012 Report Share Posted July 19, 2012 i have a green card application - my i140 was cleared in 2006. i have worked in the usa for like 8 years on h1b. but 485 was never filed. my application was later shifted to consular processing - nothing has come through in the last few years. now if i apply for a l1, how does it affect the above green card application. appreciate the feedback. Attorney_23 Posted July 23, 2012 Report Share Posted July 23, 2012 A foreign national may remain in the U.S. for a maximum of 5 years in L1B status (7 years in L1A). However, time in H1B status counts against the maximum time allowed in L1; and, unlike H1B, a foreign national cannot extend past the maximum time based upon a pending green card application. A foreign national would have to then remain outside the U.S. for 1 year before being able to reenter in L1 status (assuming the other criteria for this status are met.) Link to comment
