predicament
Hello everyone, This is my first post. I am in a rather strange predicament. 1. The 6th year on my H1-B expires this November. I was able to get an extension on H1-B to March 2013. 2. PERM Approved from Company X. 3. I-140 has been filed with no approval. 4. Company Y wants to hire me, and is willing to process my Green Card. They are willing to re-file PREM. 5. Company W, my previous company is also ready to hire me back. They are also willing to continue my PERM. Here's my predicament: 1. What should I do? Is it risky to join company Y? 2. Do I risk losing my I-140 and PERM? I was told that my PERM could be cancelled by Company X, my current employer. 3. At what point of time is it safe to port my H1-B and I-140 to a new employer, or old one? Any suggestions? pontevecchio
You can only retain the PD of an approved I-140. Link to comment
