How long can I stay way from h1 status before I can come back to H1? IMP!!!

Dear Friends,

I need urgent help with my situation.

I got my H1 stamped in Dec-2010 and is valid till Dec-2013 for a full-time job.

Because of some issues I had to travel to India and resign from my job and come back to US on H4.

I am still on H4 and hunting for job but did not get any opportunity and its been already 7+ months that I am on H4.

Now If I have a job, I will have to activate my H1 by filling a new LCA etc...(in short I do not have to wait for Apr quota to start working as said by my lawyer)

Now my doubt is, how long can I stay out of H1 status and get back with no issues???

Is there any time frame by which I should active my h1???

Please let me know.

There is nothing called activating a H1 and there is no time frame per se.
