H1b extended beyond 6yrs without labor or I140 approval. Is this an error?

Hello everyone, here's my situation. I'm in the 5th year of H1b and recently my employer applied the Labor application. It has not yet been approved.

My current H1b will end by 8/31/12. And my total 6yr term will complete by 5/29/13.

My employer applied for H1b extention from 8/31/12 to 5/29/13.

And the strange thing is the application is approved till 5/29/2015 instead of 5/29/2013.

Classification: H1B

Starting Validity Date: 08/31/12

Ending Validity Date: 05/29/15

  • How is this possible?
  • Is this an error?
  • If this is an error and no-one spots this can I stay in the country as long as the I-797 is approved for?
  • Will I face any problem when going for stamping?
  • What are my legal rights if USCIC comes back and say it was an error and asks me to leave the country immediatly?

Please guide me

None. In this situation you will be cuffed before you can say immediately. Talk to a Lawyer.
