I went to a CBP office in LA for deferred inspection and the officer told me to fill up an I- 539, the fee is $290 to apply for an extension of validity of passport. However, when I consulted my lawyer, he said that my employer needs to file an I-129 & I have to pay him $1200 for processing fee. So now, I am confused, as far as I know, I-129 is only for extension of H1 visa and my visa is still valid until 2012 so which form do I really need? I am thinking of driving to Tijuana but I'm not sure if I need a visa. Somebody please shed some light! Link to comment
pontevecchio Posted April 21, 2011 Report Share Posted April 21, 2011 You need to file a H1 extension or you can go to San Diego and then take the trolley to theTijuana border and cross over and immediately reenter the USA after asking for a new I94. You do not need a visa if you do this. Link to comment
