H1B general Question

Hello,

I have some queries related to H1B. Currently I am with Company A and ma planning to join Company B. I want to know the following situation

1. . I need to travel to India for around 2-3 weeks sometime during December12-March 13. My understanding is that I need to get a new visa stamped when I go to India in case I change the employer. Is it a correct assumption and if so what and all documents I will need when I travel to India and also visit one of the US consulate in India.

2. My passport and visa is expiring in Aug 2013 and in case I change the employer then will I get a new I797 issued which will be post Aug 2013?

3. Do I need to again apply for a new I797 once I get a new passport?

New visa is not required in your case. Use old unexpired visa with new I797 at POE.

2. Petition approval length will most likely not depend on the Passport expiry. But I94 duration will be based on passport expiry and hence make sure you have an extended passport by December.

Hi,

Regarding point 1, my only concern is that my current employer cancels my H1B and even though the visa expiry date is in future, will I be able to travel back on the same visa? The current visa that I have mentions the name of my current employer as well.

I disagree to your comment. I am not pushing or forcing anyone to reply. Forums are meant for discussing something. In fact while searching, I came to know about this forum. If you don't want to respond then don't do but please don't assume that I am pushing .
