bewildered
Hi, I am on my 7th yr of H1B and my wife is on H4. We filed for AOS and have an EAD. Now, my wife wants to work using her EAD. I have a question before we make a decision on that. I know my status on h1b will stay unaffected if she uses her EAD, however if worse comes to worse and she needs to go back to h4 how do we handle that? Are there any other gotchas to worry about because of this move. Thanks Link to comment

pontevecchio
Why would she need to go back to H4 status?? Link to comment
bewildered
If we have been victimized by any one of the unfortunate things that many people have been going through like I-140 revocation, denials, etc. I am trying to play safe and we are thinking about an exit plan. Link to comment
kalyan_ac
She can file for H4 petition as a dependent on your H1b but she may be out of status between rejection/denial to filing the petition. Link to comment
pontevecchio
First of all denial is not usually victimization. That's besides the point. She can leave anytime and come back on the H4 visa to get back in H4 status if you are invalid H1 status at that time. Link to comment
