My H1B is expiring May 2013. (completing 6 years) My employer kept saying that they will apply for GC and last minute they said they dont have enough time to apply for perm and then get the Visa extended for 1 more year. So I have to leave the country. What are my options to stay in the country? Can i look for another employer who can process GC for me. If I get another job transfer my H1 to that company will they be able to apply GC for me. Will it be too late?

Any company can file your GC if they are willing.

GC can be applied even you're not employed with that other company. So, you can find another employer who're ready to start GC right away or immediate once you join them because PRE-process meaning process before filing PERM takes average 5 to 6 months depending upon company & attorney. And once PERM files then it takes average 3-4 months for approval. So, average it may take 8-10 months for PERM approval, unless PERM goes for audit.

They must prove there are no willing and qualified applicants for the job. This is getting more difficult with the US economy.
