Can I change Jobs on EAD, while Current EAD Expired but Renewal Appl Filed with USCIS & Pending

Hi,

I am currently on Valid H1B Status with my present Employer, but I also have EAD (based on I-485 filing in August of 2007).

My current EAD expired on 05/31/2012 and my present Employers have filed for a renewal on 05/22/12 but Renewal Application is still Pending with USCIS.

I have received a recent Job Offer from a Local Company and they want me to join on EAD as they will not sponsor H1B.

Question(1): Can I join my New Job based on Receipt Notice received from USCIS for my EAD Renewal Application as I have not yet physically received my Renewed EAD Card ?

Question (2): Also, if I join my New Job on EAD, will my Spouse who is currently on Valid H4 Status need to have an EAD Approved for her ? She had EAD couple of years back, but it has expired since and not renewed as she has not been working.

1. No. But remember 401(k).

2. She will be awaiting AOS and will need a EAD if she wants to work.
