H1B extension

Hi All,

I worked in US for 4.5 years ( Sept 2006 to Feb 2011) and came to India and started working here. My H1 stamp expired last year. Now I am out of the country for more than a year. To come back US thru my old h1 employer, do I need to file new H1 or can file under cap exempt?.

I have my 140 approved.

Not sure, if it would work, so take advise from a good immigration lawyer, but you can try filing for an H1 extension based on your approved I-140.

Also what is your PD, may be you can directly file for CP if you date is current and then get your GC.

Based on your approved I-140 you can have any H1 sponsor file a H1 petition for you up to an initial 3 years to start.
