H4 to H1 Status Change.

Hi,

I am currently in US in H4 visa and have my H1b petition approved. Now I am planning to visit India for vacation.

Meanwhile my husband had changed companies while in US, so when in India we will have to go for H1b stamping as his company has changed.

My question is :

1. Can I get H4 stamped again on my passport when I have a approved H1b visa petition?

2. If I come back on H4 is there anything I need to do after reaching US with regard to my H1b petition, or can I start working come Oct 1st?

1. He does not need to get a new visa if the existing one is still valid even if he changed employers.

2. You do not need a new H4 visa if your current one is valid.

3. If your H1 was a COS from the current H4 with same A #"s you can come back to retain the H4 status from which the H1 status will accrue from October,1.
