immi001 Posted July 5, 2012 Report Share Posted July 5, 2012 Hello I worked for company A which filed for my GC. I have an approved I-140 with a priority date of December 2007 through them. My 485 was not filed as the priority date wasn't "current" then. Got laid off so currently working for company B. I am already in my 6th year of H1B. Company B has also started my GC process and has filed for my PERM(1st stage) in May 2012. If company A hires me again, based on the initial approved I-140, which the company has not withdrawn, would I get a 3 year extension on my H-1B or not? Also since I-140 is already approved and I was born in a country which is "current", would I file for just 485 or would I have to start the whole GC process from scratch(PERM, ad, etc)? pontevecchio Posted July 5, 2012 Report Share Posted July 5, 2012 Where is the question of H1? A filed your I140. Your dates are current. They presumably want you to work for them. File AOS and in the meantime transfer your H1 to them. Link to comment
