But I've an agreement with my existing employer to give 3months notice prior to leave him or pay some amount if I don't give him the notice. If my H1 already transferred to the new employer, still do I need to give the notice to my existing employer? If I don't do they take any legal actions against me. Please clarify. Thank you. If you didn't like their 3 months notice contract, why did you sign the offer at first place? Generally, except 9 states of USA, notice period is not required by law. Involve an attorney.
