H1B Transfer

Hi,

I want to transfer my H1 from my existing employer to the new employer. But I've an agreement with my existing employer to give 3months notice prior to leave him or pay some amount if I don't give him the notice.

If my H1 already transferred to the new employer, still do I need to give the notice to my existing employer? If I don't do they take any legal actions against me.

Please clarify.

If you have signed the agreement, yes, they can create the trouble for you.

If you didn't like their 3 months notice contract, why did you sign the offer at first place?

Generally, except 9 states of USA, notice period is not required by law. Involve an attorney.

Your transfer is an Immigration Matter. The contract is a civil matter. Run your contract by a state Labor Lawyer and/or abide by your contract if legal.
