vsr777 Posted June 26, 2012 Report Share Posted June 26, 2012 Hi, I work for company A on a valid H1b visa. I have an approved 1-140 from company A in EB3 with a priority date of 2008. I completed 5 years on H1b. If a company B is ready to file GC in EB-2, is it advisable to switch the company? Can a company B initiate a GC process for me without being an employee? I would like to know few details regarding future employment. Can i use my priority date from company A and port it with company B? Appreciate your advise. Thanks in Advance. Link to comment
pontevecchio Posted June 27, 2012 Report Share Posted June 27, 2012 Yes to your questions. Obviously B would expect you to join them on H1 soon. Discuss the matter with B and then your Lawyer. You need to change to EB2 or you will be stuck for a long time in limbo. Link to comment
