starlightyonder Posted June 21, 2012 Report Share Posted June 21, 2012 My husband got his GC in July 2010, we got married in 2012. Can he apply for a Green Card for me? Someone said that if we got married after he got his Green Card, he needs to wait until he becomes a citizen to apply for my GC sponsorship. I am on an H1 visa, and plan to maintain my legal status, but was hoping that my family based GC will come in sooner than a work based one (which hasn't been applied yet). Thanks for all the replies! JoeF Posted June 21, 2012 Report Share Posted June 21, 2012 He can sponsor you in Family category 2A, spouses of Permanent Residents, but there is a few years backlog for that. There is no quota for spouses of US citizens. Link to comment
