L1 to H1 B(on L1b but getting per diems not salary in USA)

Hi Attorny,

I have valid L1B till May 2013 form employer A . I am planning to get H1 B from another employer.

So new employer is asking for sallary silps but i dont get any salary in USA. I get only per diems so my

question is does it will create any problmes while application or stamping. also like to know what additional things i need to do in

this scenario?

Get a real salary. Per diem is not a salary replacement. Both the employer and you can get into quite some trouble for abusing per diems.

A foreign national in L1 status is ordinarily permitted to receive his/her salary from the foreign entity.

yes i am not recieving salary per month. I recieve salary in india, and per diems in USA.

File a complaint against your employer. If not you won't get your H1.

Don't you read responses if you have multiple threads with the same question? On L1 you are not the same as H1. A living allowance plus salary paid anywhere is what is required subject to taxation issues.
